California's Proposition 8: The Fight Continues...
I have been following the debate over Proposition 8 in California. I was really surprised when I caught a glimpse of Ted Olsen and David Boies on CNN's Larry King. For those who don't know who these guys are, they are the lawyers who were at the forefront of Bush v. Gore that ultimately resulted in George W. Bush becoming President in 2000. They have joined forces to challenge proposition 8 in Federal court on ground of the Equal Protection Clause of the Constitution. Ted Olsen is representing a number of couples who have sued to have their right to marry upheld.
As I have thought about this, I don't think anyone questions the conservative credentials of Ted Olsen. I remember his grace and dignity after the loss he suffered when his late wife was on the plane that struck the Pentagon on 9/11. I also respect the immense capabilities of David Boies and his own personal story is quite compelling. I think Larry King was right when he noted that whomever challenges this dynamic duo will have quite a fight on their hands.


















The Middle Ground
Also, are you with me that the CA constitution is plain useless? The point of a constitution is to guarantee minority rights that can't be taken away by a simple majority vote. If you can amend a constitution by a simple majority vote, why bother even having one?

I concur wholeheartedly about the dysfunctional nature of California Government. I have written about the useless nature of California Government in Outsider views (http://www.outsiderviews) and am continuing to think about what needs to be done. What is certain is that the way forward, right now, is not working.
